Please read these terms and conditions carefully. By submitting your phone number or otherwise agreeing to receive SMS/text messages, you expressly consent to receive non-marketing (transactional) messages from or on behalf of Buy Gold and Silver Corp (“BGASC,” “Buy Gold and Silver Coins,” “we,” “us,” or “our”), including SMS/text messages made with an automatic telephone dialing system, and you agree to be bound to these BGASC SMS Terms and Conditions (“SMS Terms”). Likewise, by checking a box to sign up for, or enrolling in a program to receive, marketing messages, including SMS/text messages made with an automatic telephone dialing system (together with transactional messages, the “SMS Service”), you agree to be bound to the SMS Terms. You also agree to be bound by BGASC’s Terms and Conditions, which are incorporated herein by reference, including, but not limited to, provisions concerning binding arbitration, class action waiver, waiver of jury trial, and consent to electronic communications, and any other applicable terms and conditions related to your use of our Services. IF YOU DO NOT AGREE TO THESE SMS TERMS AND OUR TERMS AND CONDITIONS, YOU MUST IMMEDIATELY DISCONTINUE YOUR PARTICIPATION IN OUR SMS SERVICE BY FOLLOWING THE BELOW CANCELLATION INSTRUCTIONS IN SECTION 4.
You must be eighteen (18) years old and a resident of the United States to enroll in the SMS Service. In order to enroll in the SMS Service, you must provide a mobile phone number for which you are either the subscriber or the customary user authorized by the subscriber.
Transactional Messages. When you provide your mobile phone number to BGASC online, over the phone, by sending us an SMS/text message, or through any other means, you consent to receive transactional, operational, or informational SMS/text messages at that phone number, including but not limited to order confirmations, cart abandon messages, and shipping and delivery notifications. Please note that we may not be able to deliver messages to all mobile carriers.
Marketing Messages. In order to receive marketing or promotional SMS/text messages, you must provide your prior express written consent. You can provide this prior express written consent to receive marketing or promotional SMS/text messages at your mobile number by providing your agreement online, over the phone, by sending us a SMS/text message, or through any other means, so long as your affirmation constitutes a valid electronic signature under applicable law.
In all instances, consent to receive SMS/text messages (i.e., either transactional or marketing) is not a condition of purchasing any goods or services, and you understand and agree that all SMS/text messages may be sent using automated technology, may be recurring, and may vary in message frequency.
SMS/text message services are provided on an “AS-IS” basis. Not all mobile devices or handsets may be supported, and our messages may not be deliverable in all areas. BGASC, its service providers, and the mobile carriers used for the SMS Service are not liable for delayed or undelivered messages.
The content of our messages may not be available and viewable on all mobile phone carriers. If your wireless carrier does not permit text messages, you may not receive the text messages.
Message and data rates may apply to each text message sent or received in connection with our text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans). We do not impose a separate fee for sending SMS text messages. You acknowledge that you are responsible for any message, data, or other charges incurred (usage, subscription, etc.) as a result of using the SMS Service. Under no circumstances will we or our affiliates be responsible for any text messaging or wireless charges incurred by you or by a person who has access to your wireless device or telephone number.
To stop receiving SMS/text messages from BGASC, you agree to reply STOP, CANCEL, QUIT, END, or UNSUBSCRIBE to the number sending the message, following which you may receive one additional communication confirming that your request has been received and processed. If your opt-out specifies that you only want to opt out of one type of SMS Service (e.g., only marketing messages), you will remain opted-in to the other SMS Service messages (if applicable) unless you opt out of receiving those types of messages separately (e.g., there are separate opt-outs for transactional and marketing messages). You acknowledge that our SMS/text message platform may not recognize and respond to unsubscribe requests that do not consist of only the word STOP, and you agree that we and our service providers will have no liability for failing to honor such requests.
After opting out of receiving text messages, you may re-enroll in any BGASC SMS Service by providing the consent described in Section 1 above.
In the event that you change or deactivate the mobile phone number you have provided to us, you must update your account information and the phone number(s) associated with your account to prevent us from inadvertently communicating with anyone who acquires any phone number(s) previously attributed to you. If you wish to continue receiving SMS/text messages at your new phone number, you must resubscribe your new phone number to our SMS Services by providing the consent described in Section 1 above.
These SMS Terms may be updated by BGASC at any time without prior notice. We will indicate that the SMS Terms have been updated by changing the last modified date at the top of these terms. By continuing to be enrolled in any the SMS Service, you agree to any changes to the SMS Terms.
